CMPA-BC Producer’s Branch May 2013 E-Update

Lots of things have happened since our last E-Update in December. Hopefully this newsletter will provide an overview of some of our key activities and priorities over this past quarter.  In particular, I want to draw attention to our Provincial Election Resource Kit (found in the Government Relations section) that we compiled to assist members with messages and activities to consider during this important provincial election campaign.  I also want to welcome back Melanie Le Phan to the position of Administrative Coordinator. Melanie has just completed her studies at UBC and is joining us full-time as of this week. We are also fortunate to have Linda Hay with us as Senior Project Manager working on a part-time basis in support of Industrial Relations and Operations/Member Services activities. Linda will be known to many of you as an experienced Producer, Production Manager and Head of Production and her career spans most genres, including series television, feature films and commercials.  As always, I am proud of the scope of work accomplished by our small staff team here in BC and want to thank all of them for their efforts over the past months.

Finally spring in Vancouver.  Change is in the air, the weather is improving and negotiations with UBCP were successfully concluded in April.  The CMPA-BC and the AMPTP reached an agreement in principal with UBCP on March 12, 2013 and I am pleased to say that UBCP members ratified the terms of the new 2012-2015 BCMPA on April 17, 2013.  This means the long cycle of bargaining has ended – it began with the DGC-BC in November of 2011 and continued in 2012 with the Joint Council (IA891, IA,669 and Teamsters 155), the WGC and ACFC West and carried over with UBCP into 2013.  Most of the aforementioned agreements will expire in 2015 so we will probably start prepping for the next round of bargaining in early 2014 but until then we have time for many new projects and plans and bring news of a few of those to you in the sections below.

Jenn Buchanan – Safety Committees on Productions

Jenn will be in charge of kicking off our new Film & TV Safety Outreach in May of 2013.  Jenn will be conducting some polling in April and when the results are in will assess member needs and make recommendations.  Jenn will be visiting sets over the next few months with Marty from ActSafe in an effort to get all of our members on board forming pro-active and responsive Safety Committees on every production.

Linda Hay – Stats Gathering and Strategy

Linda Hay has renewed her part-time contract with the CMPA-BC and is spearheading the production stats gathering project we have wanted to commence for some time now.  The data will be conveyed back to the CMPA-BC Branch in the form of a searchable, flexible and inter-connected report which will then be kept up to assist in identifying trends, chart the volume of production (Service and Domestic in all categories), track BC member access to provincial and federal funding and help plan future CMPA strategies.

I am pleased to announce Sarah Tarry (DHX Media) has returned from mat leave and will be re-upping to Chair the CMPA-BC IR committee for the next year.  IR Committee members for 2013/2014 are Andrew Williamson (Lark Productions), Brad Van Arragon, Karen Edwards (Pictopia Pictures), Marnie Young (Front Street Productions), Laura Lightbown (Terra Films), Tim Carter (Contradiction Films) and Paddy Bickerton (Reunion Pictures).  Thanks to all for volunteering your time.

CMPA Membership Renewal

April 1st marks our new 2013/14 fiscal year which coincides with the CMPA’s annual membership renewal period.  Lisa Moreau our fantastic Manager, Memberships and Special Events has been sending reminders over the past months that point to our on-line registration process.  On a side note, ‘BC Notes to Members’ are now being archived for your reference in the Members Only section of the CMPA website under Industry Updates.

Michael Hennessy March Visit

CMPA President and CEO Michael Hennessy visited Vancouver from March 12th – 13th.  Activities included a dinner with members of BC Branch Council and BC National Board members, a presentation of National CMPA Priorities at the March Branch Council meeting, meetings with BC Film+Media, Magnify Digital, Telefilm Canada and a group session with CMPA-BC Interactive Members.

Telefilm Canada and BC Feature Film Committee

A CMPA-BC Feature Film Committee has been created and Mary Anne Waterhouse (Quadrant Motion Pictures) has agreed to act as Committee Chair.  The Committee held its first meeting in late January in advance of a meeting with Telefilm Canada’s Dave Forget and Michel Pradier regarding recent changes in the Development Program.  The Committee identified key issues to be discussed at the meeting with Telefilm and then circulated that list to a larger group of feature film producers who also participated in the meeting.  We are set to meet with Telefilm representatives later this week to discuss upcoming changes to the Performance Envelope System which are to take effect in the 2014/15.

Advocacy Update

The issue of tax credits for the film/TV sector, and concerns about the general health of our industry have been prominent in the media over the past few months. Although CMPA-BC recognizes that parts of the film/TV sector are experiencing major challenges, our organization’s consistent message to government and media is one that emphasizes a positive vision for the future.

For the past 18 months, the CMPA-BC has been actively engaged in government relations activities focused on promoting the importance of the creative industries in British Columbia. Like other jurisdictions around the world have acknowledged, the creative industries are a key component of the development of a diversified knowledge-based economy.  We have partnered with the music, book publishing and magazine industries to carry out this work, recognizing that together the creative sector represents over 85,000 jobs and contributes $4 Billion in GDP to the provincial economy. We are calling for a strategy that focuses on competitive tax policy, marketing and export development, venture capital, research & development, and skills retention/talent development across the creative sectors.

As part of our activities, we released a report “From the Margins to the Mainstream: Moving BC’s Creative Industries Forward” proposing that the creative industries be recognized alongside other key industry sectors by government.  We recommend the adoption of a cross-sectoral approach in BC, including funding of a “BC Media Development Corporation” entity, and a cross-ministry provincial working group.

Creative BC Announcement

On January 31, 2013 the Provincial Government announced the creation of a new agency “Creative BC” responsible for promoting and championing the creative industries in the province.  According to the government, “the agency will take a strategic, consolidated approach to policy development, tax credit administration, industry partnership, promoting emerging markets, innovation, and the development and marketing of BC’s creative products and services.  Creative BC will bring together funding for film, television, digital media, music, and book and magazine publishing in one agency”.

The new agency will merge the services and programs of BC Film + Media and the BC Film Commission along with existing programs across the other creative sectors.  The agency is tasked with creating a five-year strategic plan for the creative industries and a review of the effectiveness of existing government programs.  Creative BC is operational as of April 15, 2013.

Chair Brian Hamilton took part in the announcement and you can read his remarks here.  In addition, we released a joint statement with other creative industry associations stating our support for the agency as a first step towards keeping BC’s creative industries competitive.

We Create BC

At an Industry Town Hall meeting in January, MPPIA launched a public relations campaign targeted at both the general public and government to “raise the profile of the province’s motion picture production industry: jobs, people, families, students, our investments and accomplishments, and our future potential as the backbone of BC’s creative economy.”  A dedicated website has been launched and active Facebook page.  CMPA-BC is contributing to the campaign by creating a series of “I Create BC” vignettes that showcase both youth working in the industry and those interested in working in media.  Thanks to Paperny Entertainment, who have created a sample vignette.

Provincial Election Resource Kit for CMPA-BC Members

On Tuesday, May 14, 2013 British Columbians will go to the polls. As an industry association, CMPA-BC has been advocating on behalf of our industry with both elected officials and senior staff within Government and the Official Opposition.

As the election nears, there will also be opportunities for members to engage at a local level as candidates for all the main parties will be actively campaigning in your community. While the CMPA-BC will not endorse or support any specific political party, we do encourage members to get involved and be a voice for our industry.

We have compiled this Provincial Election Resource Kit  to equip you with the resources, tips, and information you will need to ensure our message is heard in the upcoming election. We have also provided some information on the main political parties in BC, and some of their recent statements regarding the film and television industry.

BC-UK Co-Production Forum – February 3-7, 2013

In partnership with BC Film+Media, the BC Film Commission and MPPIA, CMPA-BC coordinated a targeted co-production session in London and Manchester/UK.  The intention was to update producers on soon to be announced changes to the UK’s tax incentives with respect to dramatic television series and to build co-production relationships with UK companies and broadcasters.  13 BC production companies participated along with representatives from 5 Canadian Broadcasters, BC Film+Media, Telefilm Canada and CMPA-BC.

    

The Creative Dynamic in Episodic Television – Let’s Talk

Held at the Shangri-La Hotel on February 16th and jointly produced with the DGC-BC.  Three separate panels discussed the creative relationship between Directors and Producers and the challenges and rewards this creative dynamic brings to series television. The panel discussions were informed by the results of a survey which was sent to all CMPA-BC and DGC-BC Director Members in advance of the event.

Opening the Book on Film 3 – March 27, 2013

After two successful conferences in 2008 and 2009 bringing film and television and book publishing/literary industry representatives together, we again hosted with BC Film+Media and the Association of BC Book Publishers our third event on March 27.  This half day session provided opportunities for business to business meetings and a networking reception.  Keynote speaker Robert Tercek’s inspiring presentation “Inventing the Future” can be viewed here.

    

Copyright Forum – June 8, 2013

CMPA-BC is partnering with Music BC, Magazines BC and the Association of BC Book Publishers on a session to update members on the implications of the Copyright Modernization Act – Bill C-11 now in effect.  Roanie Levy, Executive Director of Access Copyright will be the keynote speaker and Kyle Fogden of Fogden Chandler will present material related to the film, television and digital media sectorsLocation and timing for the event will be finalized in the coming month.

Merging Media Conference 2013 – October/November TBC

Our fourth annual Merging Media Conference programming will focus on “Going Global”.  More details to follow as we are in the process of changing the Conference venue and this may effect dates. CMPA-BC Producer’s Branch December 2012 E-Update


 
 
As 2012 draws to a close, I want to take this opportunity to thank the BC Branch Council (especially Chair Brian Hamilton) for their commitment and engagement over this past year. In addition, Gigi and Jennifer must be recognized for all the long hours dedicated and their hard work in the Industrial Relations area.  We’ve got a busy 2013 ahead and staff are looking forward to some down time over the holiday break.  Please note that all CMPA offices will be closed from December 24 – January 4.  All the best for 2013!
 
 
 
 
 

 
It’s almost that time of year when we leave behind our work, replace the bargaining dates in the calendar with time for family and friends and recharge our batteries for the upcoming year.  Jenn and I will head out on December 21, 2012 and return to the office on January 7, 2013 so I wanted to provide you with a few updates before the holiday break.

Labour negotiations update:

November, 2012

A new WGC agreement for the term of Nov 1, 2012 through Dec 31, 2014 was successfully negotiated and ratified by the CMPA, the APFTQ and the WGC.  Please go to the WGC website (www.wgc.ca ) or the CMPA website (www.cmpa.ca ) for a copy of the MOA and details on rate increases.

December 2012

We successfully negotiated with ACFC in late November and ACFC members ratified a new three year agreement on December 2, 2012.  The terms of the current agreement (which expires on Dec 31, 2012) will be extended through March 31, 2013 and the terms of the new agreement will come into effect April 1, 2013 and expire on March 31, 2016.  The new contract will be posted on the CMPA website in the BC Industrial Relations section before the holiday break or you can go to the ACFC website and download a copy.  Many thanks to our bargaining committee members Laura Lightbown and Bridget Hill for their time and wise counsel.

ACTRA and the CMPA/APFTQ reached an agreement in principal on December 3, 2012.  The new IPA includes annual increases of 2% in rates paid to Performers over its three year term. If, as expected the agreement is ratified in mid-January 2013 new rates and terms will go come into effect on January 1, 2013. Jenn and I attended all of the bargaining sessions for the ACTRA as observers and came away very impressed with the skills of Reynolds Mastin (Chief Negotiator for the CMPA), his team and the dedication of the Producer members who volunteer their time to attend negotiations.  Well done all!

Once the CMPA and ACTRA had an agreement in principal and as expected, the UBCP presented us with another counter to our final offer from June of 2012.  The Negotiating Producers (the CMPA-BC and the AMPTP) set up a date with the UBCP bargaining committee members to meet and discuss the offer in person on Dec 18, 2012.  Carol Lombardini flew in from LA and we went back to the table to see if we could reach an agreement.  We could not agree on terms so the UBCP will now call for mediation in the matter and we expect to schedule mediated bargaining sessions in the early part of 2013.  Please keep signing your Safe Harbour agreements for productions going into prep. The terms of the 2009-2012 agreement still apply.

WorkSafe Update:

We received word on November 29, 2012 that the Board of Directors of WorkSafeBC met and approved the proposed Policy to provide extended workers compensation coverage to individuals working on provincial productions.  The new policy will come into effect January 1, 2013.

The Assessment Department of WorkSafeBC generated a draft application form and met with the parties on December 17th, 2012 to consult with regard to the process of application for coverage, the administration of the new policy, documentation required and registration and coverage issues.  The CMPA and the AMPTP are working together on generating a document covering all the issues.  We will send out to all concerned before the holiday break.

And that’s just about a wrap for 2012.  A little more to do tomorrow and then we are closing the office and going offline for the break.

2013 Branch Council Elections 

This year’s Branch Council election results were announced and approved at the Annual General Meeting on December 12th.   We are pleased to report that of 70 ballots distributed, 35 completed ballots were returned – a 50% voter turn-out! Returning Branch Council members are Karyn Edwards (Brightlight Pictures), Brian Hamilton (Omnifilm Entertainment), Jayme Pfahl (Gang of 2 Productions), Kim Roberts (Honalee Productions), Cal Shumiatcher (Paperny Entertainment) and Elyot Waller (Nerd Corps Entertainment).  New members elected this year are Jeff Bear (Urban Rez Productions) and Barb Harwood (Thunderbird Films). The 2013 Executive was elected at a subsequent Branch Council meeting as follows: CHAIR – Brian Hamilton, VICE-CHAIR – Cal Shumiatcher, SECRETARY – Elyot Waller, TREASURER – Jayme Pfahl.  Special thanks to Matt Toner (Zeros to Heroes) and Mary Anne Waterhouse (Quadrant Motion Pictures) for their participation as members of the 2012 Branch Council.

Telefilm Canada

Over the past few months CMPA-BC has facilitated two meetings with Telefilm’s Carolle Brabant (Executive Director) and Dave Forget (Director, Business Affairs and Certification) to discuss both the decline in production and decrease in Telefilm financing to BC in recent years.  As a result of these meetings, Telefilm has committed to ensuring decision-makers Stephanie Azam and Michael Pradier visit BC four times per year to meet with BC producers, to including CMPA-BC and BC Producers in an upcoming review of recent changes to the Development Program and to continuing the dialogue with respect to upcoming changes to its Production Program. In addition, we will explore potential partnerships in our international marketing efforts.

Canada Media Fund

CMPA-BC staff continue to participate in various CMF’s Working Groups including the WG on Regional Production. We were pleased see that the CMF recently changed the status of Vancouver to be a region with respect to CMF’s Development Program, something the CMPA had recommended.  As the CMF prepares for an update of their guidelines for fiscal 2014/15 we will continue to participate in these consultations in the New Year.


Creative Industries Coalition 

CMPA-BC and partner industry associations Music BC, the Association of Book Publishers of BC and the Magazines Association of BC continue to advocate for the adoption of a cross-sectoral creative industries strategy in BC. We note the compelling $4.0 Billion economic contribution made by the creative industries along with the impressive 80,000 jobs in the sector and ask that it be recognized alongside other industry sectors. The coalition made a presentation to the Standing Committee on Finance in October and has had numerous meetings with politicians including MLA’s Carole James and Bruce Ralston (NDP Election Platform Co-Chairs) and Culture Minister Bill Bennett.  We met with Brian Coxford (Global BC TV) and Rick Cluff (CBC Radio) to pitch stories on the creative industries strategy.  Global ran a two part story this fall – links here:

Strategic Review of Screen-Based Industries in British Columbia

The Province launched the first ever review of the economic impact of the screen-based industries in BC including film, television, interactive media, VFX/animation and gaming.  Other partners in the review include Vancouver Economic Commission, CMPA-BC, MPPIA, BC Film + Media and Wavefront.  This project is currently on hold until more data on digital media becomes available.  Nordicity is producing a Canadian Interactive Industry Profile for the Canadian Interactive Alliance which will solicit more statistical information from BC’s digital media industry that can be used in the BC report.  An Economic Profile of the Film and Television Industry is currently in the process of being finalized.

The Canadian Media Production Association’s (CMPA) Prime Time in Ottawa conference is a national networking event for Canada’s most prominent business leaders, decision-makers and policy experts in the television, film and digital media production industry.

CMPA Producer Delegation to Brazil – February 18-23, 2012

The Canadian Media Production Association and the Canada Media Fund are organizing a trade-focused delegation to Rio de Janeiro, Brazil from February 18-23, 2013 to participate in RioContentMarket. Up to 10 producers will be given the opportunity to fully participate in RioContentMarket 2013, including conference panels, business to business meetings and a number of networking events.  Financial assistance will be available to help offset a portion of travel and accommodation expenses.

Merging Media Conference Update

Our third annual Merging Media Conference and Master Class took place on October 25 + 26, 2012. CMPA-BC Producer’s Branch October 2012 E-Update


Wow – can’t believe it’s October already!  Lots to update members on since our last e-newsletter in late June.  We are pleased to welcome Jennifer Buchanan and Debbie Millette to the BC Producers’ Branch.  Jennifer has assumed the role of Manager, Industrial Relations and Member Services and Debbie started September 4th as our Administrative Coordinator.  Very exciting to be back up to a full staff team!  One of our goals each year in industry development is to create opportunities for members in new international markets and to that end we are coordinating a BC-UK Co-Production Forum in London/Manchester in Feb 2013 – more details and application form can be found in the Industry Development Section.  We are also pleased to be co-presenting our third Merging+Media Conference later this month.  Christine has some amazing speakers / panelsists coming and there is a full slate of broadcasters participating as well.  This event has emerged as the leading “cross-media/convergence” conference in Vancouver that rivals Toronto’s X-Summit and the UK’s Convergence Summit in terms of quality of speakers and networking opportunities available.  CMPA members get a 25% discount!  See details later in newsletter.

Where did summer go?  There was UBCP bargaining in LA and a trip to the Banff Media Festival (always informative and exciting) in June, new staff to train in July, a few weeks off in August and a three week road trip in September to attend meetings/bargaining prep in Toronto, then to Halifax to attend the Strategic Partners conference (co-production meetings), then onto Montreal for the last round of WGC bargaining.  Now here we are close to Thanksgiving with lots of news to share.

IR Staff news 
On July 9th, 2012 Jennifer Buchanan joined the CMPA BC as our Manager of Industrial Relations and Member Services.  Jennifer can be reached at jennifer.buchanan@cmpa.ca or give her a call at (604) 682-8619 x223.

Linda Hay also joined the CMPA – BC Branch IR team over the summer.  Linda is working part-time for us as an IR Consultant and also managing a few special projects we have on the go in the office.

Labour Negotiations
We reached a deal in principle with the WGC for a new IPA on Sept. 21, 2012 (see press release on the cmpa.ca website).  The 2010-2011 IPA expired on December 31, 2011 (the terms of which are still in effect).   We expect a ratification of the new agreement in November, 2012 so if you have productions that straddle October/November or have a production starting after mid-November please make sure to give me a call with any questions regarding pending increases to fees and fringes for WGC members.  We will make the details of the deal public for all once the terms of the new IPA have been ratified.

We are still in negotiations with UBCP.  Although we have bargained and agreed on some substantial issues to date, we have been unable to reach agreement on a few important points.  We are hoping to get back to the table soon however – so watch this space.  In the meantime the current rates in the 2009-2012 UBCP Master Agreement apply.  Again – if you have a production which straddles Nov/Dec 2012 or are thinking you may go into production in early 2013 please give me a call at the office to discuss.

The ACFC agreement expires on December 31, 2012.  We have struck a bargaining committee and are preparing proposals now.  Dates for bargaining are set for the third week of October so we hope to conclude a deal at that time.  I will update you all in our December edition of the blog.

Jennifer and I will be attending the ACTRA bargaining set for Toronto Oct 30th through Nov 2nd.  This will be the first round of negotiations with ACTRA for the terms of a new IPA to replace the expiring 2010 – 2012 agreement.  Reynolds Mastin will be Lead Negotiator for the CMPA on the ACTRA file.

We (the CMPA BC and the AMPTP) continue to work with WorkSafeBC and all interested parties to resolve the difficulties Producers are encountering in trying to get 100% WCB coverage for all employees on a production.  At our most recent meeting with the WorkSafe staff on Oct. 1, 2012 we discussed the advantages and disadvantages of the process to apply for coverage now used in Alberta.  We will propose a policy change along the same lines with the needs of BC Producers in mind.  The proposal will be put before the WCB Board of Directors in late October and we hope to hear back from them by late November.  For further detail on the changes to coverage policies at WorkSafeBC please visit our recently published CMPA WorkSafeBC Tool Kit here.

BC Film + Media Info Session Bob Wong and staff held an information session for CMPA members at the our office in August. BCFM staff reviewed programs to be launched in 2012/13 and spoke to recent changes in tax credits around copyright on interprovincial co-productions. Michael Hennessy in Vancouver We were pleased to welcome CMPA President and CEO Michael Hennessy to Vancouver on September 24 for his first official ‘meet and greet’ with BC Members.  Michael presented an overview of key industry issues and outlined the CMPA’s National priorities for 2012/13.  We will see Michael again soon at the Merging Media Conference where he is participating on a panel and moderating an industry roundtable.

2013 Branch Council Elections In early November members will receive voting packages for the upcoming election of the next BC Branch Council for 2013. In advance of this, members will have the opportunity to nominate a member for consideration and a call for nominations form will be circulated.  This year’s BC Nominating Committee is made up of Jayme Pfahl (Gang of 2), Kim Roberts (Sepia Films) and Elyot Waller (Nerd Corps).


Strategic Review of Screen-Based Industries in British Columbia
This summer, the Province launched the first ever review of the economic impact of the screen-based industries in BC including film, television, interactive media, VFX/animation and gaming.  Thanks to all of you who participated in a survey to gather employment and sales figures that will compliment BC Stats data. This larger screen-based review will include data on the film and television industry gathered as part of an Economic Impact Study already commissioned by CMPA-BC and MPPIA.

Creative BC – Creative Industries Coalition
Following the release of the “From the Margins to the Mainstream: Moving BC’s Creative Industries Forward” Discussion Paper, the CMPA-BC, Music BC, the Association of Book Publishers of BC and the Magazine Association of BC have met with NDP Culture Critic Spencer Chandra Herbert, Finance Critic Bruce Ralston and Former Leader Carole James.  In addition, the coalition met with members of the BC Film + Media Board of Directors and was asked to present at a meeting of the BC unions/guilds. A meeting has been requested with new Culture Minister Bill Bennett and the group continues to work on proposed program areas and budget for Creative BC – an economic development agency for BC’s creative industries.  A copy of the Creative Industries Discussion Paper can be found here.

CRTC Submission re: CBC Licence Renewal
CBC’s Licence Renewal Hearing is set for November 19th and CMPA-BC partnered with BC Film + Media to make a submission to the CRTC raising issues with respect to the CBC’s recent poor performance in commissioning independent production in BC.  A copy of our submission can be found here.

BC-UK Co-Production Forum (February 3-7, 2013)

CMPA-BC is coordinating a co-production forum in the UK for BC TV drama producers.  Programming is now being developed with a UK based consultant with dates set for Feb 3-7, 2013. The Forum will include case studies, broadcaster briefings, and one-on-one meetings with UK producers and broadcasters. CMPA Delegation to Argentina (November 30 – December 4, 2012)

CMPA-BC Producer’s Branch June 2012 E-Update

June 2012 – Volume 5

As staff prepare to head to a National Board meeting and the Banff World Media Festival, here’s an update on what we’ve been up to since our March edition.  You will see that we continue to be active in all areas of our operations – industrial relations, government relations, and member services/industry development. I wanted to bring to your attention a request that you will be receiving from the consulting firm Nordicity to participate in a survey as part of the Strategic Review of Screen-Based Industries in BC. This review is being conducted by the Province in partnership with CMPA-BC and other industry stakeholders. I would encourage all members to participate to ensure the best data possible is collected. More on this study in the Government Relations section of this update.

Spring has finally sprung for 2012 and with better weather comes news of changes in CMPA staff both in theVancouveroffice and on the national front, a ratified three year agreement with the BC Council of Film Unions and confirmation of upcoming dates for the continuation of bargaining with UBCP and the WGC.

Industrial Relations staff changes/departures:

Long time staff member Robyne Switzer (IR & Operations Coordinator) left the CMPA-BC in late March, 2012.  Robyne will be heading off-shore this summer to take a job in administration with a major cruise line.  We wish Robyne bon voyage and thank her for all of her efforts during her 10 years at the CMPA-BC.

Reynolds Mastin (formerly Counsel for the CMPA) was appointed Chief Negotiator and Chief Legal Officer for the CMPA and with the assistance of Warren Ross and Carol Anne DaCosta in the Toronto office, will be carrying on with a busy bargaining schedule starting in the fall of 2012.

BCCFU Master Agreement 2012 – 2015

The three Council member unions (IA891, Teamsters Local 155 and IA669) and the Negotiating Producer (the CMPA-BC and the AMPTP) renewed the Master Agreement for another three years and ratified terms as of February 28th, 2012.  The full revised agreement has been drafted and we are doing last touches before sending to the Council for publication.  In the meantime please go to the Council website http://www.bccfu.com/News.html for a copy of the MOU and the 2012 – 2015 rate schedules.

UBCP Master Production Agreement

We will reconvene in Los Angeles June 4-8 in order to continue bargaining with the Union of BC Performers.

WGC

The CMPA will reconvene with the WGC in early September, 2012 to continue bargaining the IPA.  In the meantime all Producers should be using the rates as set out in the Jan/10 – Dec/11 IPA.  Note: If an increase to the rates is negotiated and confirmed in the fall of 2012 new rates could be in effect in late 2012.  Please get in touch if you have any questions.

Telefilm Canada Development Program

In response to proposed changes to the Development Program at TelefilmCanada, CMPA-BC convened a meeting of feature film producers to discuss the potential impacts.  Based on the issues raised at the meeting, CMPA-BC wrote a letter to Telefilm Executive Director Carole Brabant outlining the CMPA-BC’s concerns about the impact of the changes on BC producers and the BC industry.  A copy of our letter and Telefilm’s response can be found here:

Terms of Trade Updates

BC members have had the opportunity to attend Vancouversessions in both March and April with Reynolds Mastin, the lead CMPA member of the Terms of Trade negotiating team.  Reynolds was able to provide an update on what is and isn’t working in this first Terms of Trade agreement between the CMPA and private broadcasters Astral Television Networks, Bell Media, Corus Entertainment, Rogers Broadcasting and Shaw Media.  The negotiating team continues to with the private broadcasters to resolve ongoing issues.


GOVERNMENT RELATIONS

Provincial Expert Panel on Business Taxation 

BC’s Minister of Finance announced in January 2012 the appointment of an expert panel to provide analysis and recommendations to the Province on business tax competitiveness and administrative improvements to streamline the PST.  The mandate of the panel is to consult with various industries impacted by the reimplementation of the PST and to come back to government with revenue neutral recommendations.  The CMPA-BC (Brian Hamilton, Elyot Wallerand Liz Shorten) appeared before the Expert Panel on Friday June 1st and made the following recommendations:

1) Review the existing tax credit programs to ensure they are keeping pace with the rapidly changing nature of these sectors.

2) Take immediate steps to mitigate the impact of the PST by announcing that the film and television industry will be treated as a manufacturer and therefore be PST exempt.

3) Introduce a financial incentive to trigger high budget Canadian dramatic and/or animated series.

4) Include writer’s fees as eligible expenses under Film Incentive BC to make our program more competitive and in line with programs offered in other jurisdictions.

Creative Industries Coalition Launches Strategic Report

On April 26 CMPA-BC and partner industry associations MusicBC, the Association of BC Book Publishers and the Magazines Association of BC launched “From the Margins to the Mainstream: Moving BC’s Creative Industries Forward”.  The report speaks to the $4.0 Billion economic contribution made by the creative industries and asks to be recognized alongside other industry sectors.  It recommends adopting a cross-sectoral approach to the creative sector in BC, asks government to set up a cross-ministry provincial secretariat, and fund a “BC Media Development Corporation” entity.  The launch received extensive media coverage including an editorial in Saturday’s Vancouver Sun which can be downloaded here.

Strategic Review of Screen-Based Industries in British Columbia

UK TV Immersion

As part of our efforts to expand into international markets, we are working with BC Film+Media to develop a BC producer immersion to theUKthis Fall.  Our intention is to update producers on recent proposed changes to theUK’s tax incentives with respect to dramatic and animated television series and build co-production relationships withUKcompanies.  Stay tuned for more information as it becomes available.

CMPA-BC and other Creative Industries Associations Partner on Strategic Report


A report commissioned by a coalition of the province’s creative industries including CMPA-BC was released today.  It says a strategic approach to the future is needed – one that includes moving this $4 billion sector from the margins to the mainstream of economic and policy thinking, something that’s key to retaining British Columbia’s creative professionals, as well as their entrepreneurship and job-creating potential. Without it, the province risks losing its best talent to places such as Ontario and Quebec with their competitive tax credits, program funding and easier access to investment capital.


The 35-page report, titled From the Margins to the Mainstream: Moving BC’s Creative Industries Forward, points to Ontario, Quebec, Britain, Australia and Singapore as some of the jurisdictions that are working with their creative industries to develop the sector’s competitive potential. The report calls for a “public-private” partnership, a three-year strategy aimed at growing the creative sector, and the creation of a BC Media Development Corporation, similar to Ontario’s Media Development Corporation, as ways to make BC more competitive.

CMPA-BC Producer’s Branch March 2012 E-Update

As staff prepares to head to our Prime Time Conference this week we wanted to send this update to let you know what we’ve been up to over the past few months.  It’s been a busy time as we continue to be active in all areas of our operations – industrial relations, government relations, and member services/industry development.  In particular, I’d like to highlight the info below about a special discounted CMPA rate for Banff and also note that new information regarding membership rates and renewals is scheduled to come your way in March.

Welcome to 2012 everyone.  The BC Industrial Relations team is carrying on where we left off in December with a busy bargaining schedule lined up for the New Year.  Some of the highlights follow.

BCCFU Master Agreement 2012-2015

In early January we were back in Los Angeles to conclude bargaining with the BC Council of Film Unions.

An agreement was reached between the CMPA, the AMPTP and the BC Council of Film Unions on January 10, 2012.  The MOU has been drafted and language agreed upon.  The BCCFU is recommending ratification to their membership (approval of the deal is required by two of the three Council member unions).   The MOU was sent out to the Council membership on Jan. 26, 2012 and the results are expected by Feb. 28, 2012.

The IR Team will be travelling to Los Angeles for June 4 – 8, 2012 for further bargaining with the Union of BC Performers.  We look forward to meeting our colleagues again and will be meeting with the UBCP Negotiating Committee through the spring to review the proposal package and give any updates.

UBCP Animation Agreement

We meet with our Negotiating Committee the week of Feb 20th and will propose bargaining dates to the UBCP after our meeting.  We are looking at May, 2012 dates for bargaining.

WGC

We will meet the WGC again in the summer to return to the bargaining table and hopefully conclude negotiations on the new IPA.    We will be focusing particularly on Animation, Bibles, Credit Arbitration, Options and Digital Production.

Terms of Trade Sessions (March 12)

Proposed Tax Credit Changes re: Interprovincial Co-productions Announced in 2012 Provincial Budget

Film Incentive BC Tax Credits for Eligible Interprovincial Co-productions Allowed Under the Film Incentive BC tax credit, interprovincial co-productions are subject to a reduction in the credit when corporations own less than 100 per cent of the copyright. This copyright grind is removed and copyright ownership requirements for interprovincial co-productions are amended for productions with principal photography starting on or after January 1, 2012.  Information can also be found on the BC Government webpage where proposed changes are outlined.

This change was included in the recommendations presented by the CMPA as part of the Pre-Budget Consultation Process.  While it is disappointing that all of our recommendations were not implemented, the CMPA Government Relations Committee remains active and is working with government and the opposition to address the competitive challenges BC producers currently face.

Economic Impact Study

CMPA-BC and MPPIA have engaged national consulting firm Nordicity Group Ltd to prepare an analysis of the economic impact of film and television production in British Columbia. This study will provide a much needed, up-to-date measure of the contribution the industry makes to BC’s economy and the provincial treasury and will include key economic indicators: employment levels, GDP and direct and indirect tax revenues. A comprehensive study of this kind has not been undertaken in BC since 2005.

December 2011 – Volume 3

At our Annual General Meeting last week staff reported on various activities over the past year and we have included those updates in this newsletter. The Government Relations and Industrial Relations overviews are in dedicated sections of this report.  I’d also like to highlight key industry development initiatives undertaken throughout the year including the Bell Broadcast and New Media Fund Industry Reception (March), Merging Media Transmedia Seminar + Lab (April), Maximizing Tax Credit Session (May), LA Market Accelerator (June), Terms of Trade Roadshow (July), SIGGRAPH Business to Business Meeting Program (August), and the Merging Media Conference + Master Class (October).  Note: All CMPA offices will be closed from December 24 reopening January 9, 2012. On behalf of Gigi, Robyne, Melanie and myself I want to wish everyone a safe and happy holiday season and we look forward to working with you in 2012.

2011 has been a very busy year for the BC Branch IR team.  Since early summer Robyne and I have been in the midst of prepping or negotiating contracts with the DGC-BC, the UBCP (Performers), the BC Council of Film Unions (Teamsters 155 (Drivers), IATSE 891 (Technicians) and IATSE 669 (Photographers) and the WGC – Writers Guild of Canada.  Please see below for a short update on the status of the negotiations.

Negotiations Update: DGC-BC – A new Agreement was ratified byDGCBC members Nov 8, 2011.

Term: Three Years – April 1, 2012 to March 31, 2015.

Highlights:  New Sideletter No. 4 – increases to budget breaks on almost all types of production make more many more projects eligible for the Low Budget discounts.

Negotiations Update: IATSE 891 (Film Technicians), IATSE 669 (Camera) and Teamsters 155 (Drivers) – collectively the “BCCFU” or Joint Council - We were not able to fully conclude bargaining by the last day of scheduled negotiations on October 28th, 2011 inLos Angeles.  We anticipate scheduling more days in January when we hope to conclude negotiations.

Negotiations Update: UBCP – We are currently in a recess with UBCP.  We left off bargaining by mutual agreement on Wednesday, Nov 16, 2011 after three (of the scheduled five) days of negotiations inVancouver.  We expect to continue negotiations in early Spring 2012.

Negotiations Update: WGC – The CMPA began bargaining in the first of three scheduled sessions Nov 30 and Dec 1, 2011 inMontreal. We meet again inToronto on Dec 15 and 16, 2011 and for a third session on Jan 25 and 26, 2012.  We expect to conclude negotiations in early spring 2012.

Thank you to all of the members who worked on the various bargaining committees and to those who submitted proposals for discussion.  We look forward to updating you in our next issue regarding progress on all of the above negotiations.

Terms of Trade – The CMPA Terms of Trade team has compiled a “Handbook” designed to be a guide to provide you with our interpretation of how Terms of Trade should be applied in your day to day dealings with the five private English language broadcaster groups who are signatories to this agreement.  The Terms of Trade agreement is a living document, meaning that as we gain experience working with it we will, no doubt, make modifications to this guide. GOVERNMENT RELATIONS

Note from Brian Hamilton, Chair – BC Producers’ Branch (November 2011)

On behalf of the BC Branch Council, I’d like to take this opportunity to identify some key government lobbying issues the CMPA-BC is working on, to update you on recent efforts, and to ask for your input and help.

We have held numerous meetings with government officials and politicians over the past 24 months, with the three ministries affecting our sector: the Ministry of Finance, the Ministry of Community, Sport and Cultural Development (which oversees BC Film + Media and the film/TV/digital industries), and the Ministry of Jobs, Tourism and Innovation (which makes recommendations on supporting key job generating industries). We have met with elected ministers, and also separately with their top officials (Deputy Ministers, Assistant Deputy Ministers, etc.) and also with more junior staffers. We have appeared and gone on the public record at the BC Government’s Pre-budget Consultation Committee, which is the key forum to advocate for changes to the upcoming provincial budget.

In our meetings, we emphasize the importance of a healthy domestic industry in the terms that theClarkgovernment responds to: the language of jobs and economic activity. We talk about the importance of retaining control of intellectual property and how our industry reinvests the profits locally to create more jobs.  We point to statistics that show significantly reduced levels of BC-owned production over the last 2-3 years, particularly in scripted TV series. In explaining this, we refer to the “triple whammy” of cuts to BC Film, lower rates for tax credits compared toOntarioand other jurisdictions, and finally the prospect of the reintroduction of the PST. Another contributing factor is the increased concentration of decision making inToronto– none of the key broadcast buyers or film distributors have western offices any more.

To date, despite our message to government that something needs to be done, there have been no substantive changes offered to address the competitiveness gap facing the domestic industry.  We have asked government to work with us to address this situation and have outlined three action items in a recent government submission.  These actions are:

Action 1

When BC reverts to PST, define digital/film/TV production and post production as “manufacturing” for the purposes of calculating PST. This will create jobs by putting BC employers on an even playing field with other provincial jurisdictions.

Action 2

Further to the Premier’s commitment to trigger a competitive review of business taxation for the film/TV/digital sectors, immediately strike a working group bringing government and industry together to complete this review as a priority. The working group could consider administrative tax credit adjustments to significantly and immediately improve the investment climate and competitiveness for new projects to be developed and produced inBritish Columbia:

-  Include writer fees as eligible labour expenditures;
-  Remove the copyright grind on inter-provincial co-productions;
-  Provide a 5% bonus incentive for new TV pilots and series;
-  Accelerate the payment of FilmIncentiveBC(FIBC) tax credits paid to BC-owned employers to enhance their competitiveness vis a vis other jurisdictions.

Action 3

Implement a repayable BC Production Investment Fund of $2Million/year over 5 years to enable private sector employers (producers) to jump start projects, create jobs, hire more graduates from BC’s expanding higher education sector, retain Intellectual Property and work towards a fully integrated production centre in BC.

BC Success Stories:  We are building an inventory of BC projects that have received BC Film support to demonstrate how vital that funding is to trigger projects in the province.  In the New Year,Liz Shortenwill be in touch with members directly to facilitate the gathering of information.

Notice of Production:  Starting in January 2012, CMPA-BC wants to start tracking production activity of members in the province so we have a better sense of the types and level of production activity throughout the year. More info on this to come.

Conference and Master Class – Vancouver

Transmedia Seminar and Lab – Toronto

After a successful launch here in Vancouver this past April, CMPA is pleased to be partnering again on this lab featuring transmedia expert Anita Ondine. The combined seminar+lab curriculum provides a unique and intensive look at transmedia from “Conception to Consumption”.  Covering the key areas of transmedia development, financing, design, production and distribution both in theory and through hands-on lab work that identifies and brings together key media professionals from a broad spectrum of media disciplines.  More information and registration details can be found here:  http://mergingmedia.ca/media-to-toronto

Melting Silos

Open Call to BC based Filmmakers and Digital Media Companies for Melting Silos Concept Development Proposals

Agentic Digital Media is launching the third year of Melting Silos, a set of workshops that connect local filmmakers and digital media professionals in order to develop transmedia projects and to build common knowledge between the two sectors. Melting Silos is now accepting applications from BC based filmmaker/digital media partnerships on narrative projects with transmedia potential. Five teams will be selected to participate in 2 two-day workshops, made possible by the financial participation of Telefilm Canada’s Skills and Screens Program, BC Film and Media and the CMPA-BC Branch. CMPA- BC Producers’ Branch E-Update

June 2011 – Volume 2

As I get ready to take a few vacation days away, I wanted to reflect briefly on the past two years of activity here at CMPA. We are fortunate to have a great staff team in place with Gigi, Kristyn and Robyne and an engaged BC Branch Council led by Chair Brian Hamilton.  (See note regarding staff information and responsibilities in Contact section below).  I am pleased to report that the organization is now in a financially healthy position (both in BC and Nationally) and as a result we are planning to add a BC staff member in the Industrial Relations area  this fall to support our IR capacity.  We launched Merging+Media programming initiatives last year, held numerous info sessions on various topics (HST, Tax Credits, Terms of Trade), and have been active in the Government Relations area developing our own voice with support from our GR firm Canadian Strategy Group.  On the IR front, ACFC negotiations were completed last year and the team is prepping for a busy fall of bargaining. We remain very involved in the work of MPPIA-BC where the CMPA sits on the Executive and Government Affairs Committees.  There is much yet still to accomplish and I know I can speak on behalf of all of the staff in saying that we are committed to working with you, representing your interests and the health of the BC based/domestic industry in all that we do.  See you in mid July!

BC IR Committee Update – Sarah Tarry, DHX Media has been appointed chairperson.

Negotiations Update – Bargaining sub-committees are being formed and members are welcome to put their names forward to participate.  CMPA-BC IR staff will be contacting members to bring any issues and concerns forward for discussion and possible inclusion in the negotiations.  Dates have been confirmed with the DGC-BC for September 12-16, 2011 and dates with the BCCFU are being held for October and early November 2011.  The WGC has requested two days in early October to begin bargaining.

ACFC West – CMPA Pilot Incentive Sideletter – The CMPA-BC and ACFC West recently negotiated a Pilot Incentive Sideletter for stand-alone CAVCO certified Canadian Pilots.  Only CMPA members are eligible for the terms of the agreement.  Rates, Terms and Fees are those in the current ACFC Sideletter No. 1 with the exception of a 0.5% CMPA Administration Fee.  Please contact Robyne or Gigi at CMPA-BC office if you have an eligible production and we will forward the Pilot Incentive Sideletter to you.

Producer, Line Producer and Production Manager Roundtable July, 19th – CMPA-BC is organizing a roundtable in coordination with the AMPTP, DGC-BC and Actsafe. In order to optimize attendance and allow for variable PM/Producer schedules the roundtable will run twice; once in the morning and once in the late afternoon.  Agenda items will include updates on important safety information as well as consultation for upcoming bargaining issues.  All producers and production managers are strongly encouraged to attend one of the two identical presentations.

WGC Animation Sub-Committee June 2, 2011 – CMPA IR staff and National Animation Sub-Committee members met with the WGC in Toronto to continue discussions regarding minimums for Animation writers.  There was no resolution, this matter is expected to be raised by the WGC in the upcoming IPA negotiations.

Terms of Trade – The CMPA has successfully negotiated, on behalf of its members and the entire Canadian independent production sector, a Terms of Trade agreement that came into effect June 1st 2011. This is a historic deal that will redefine the relationship between producers and broadcasters. The agreement has been signed between the CMPA and Astral, Bell Media (CTV), Corus, Rogers and Shaw Media. Negotiations with the CBC have begun. Canadian Producers and Broadcasters will be required to adhere to Terms of Trade on a go-forward basis – it will apply to all independently produced projects developed and commissioned by the private broadcast groups. NOTE:  Our Terms of Trade CMPA staff team will be travelling across the country starting next month to conduct information sessions with producers and we will let you know as soon as the Vancouver date has been confirmed.  More information can be found on CMPA website at:  http://www.cftpa.ca/membership/terms_of_trade/

National Board Election – The results of the recent national election saw 4 BC Board Members joining the Board for a two year term – Rob Bromley (Force Four Productions), Brian Hamilton (Omni Film Productions), Alexandra Raffe (Thunderbird Films) and Cal Shumiatcher (Paperny Films).  Also, we are pleased to report thatAlberta based producer Tom Cox was elected as National Board Chair for another year.

Our Government Relations team of Rob Bromley, Brian Hamilton and Liz Shorten have been extremely busy over the past few months meeting with provincial government officials to discuss the importance of the BC Based industry and the contribution made by BC production companies.  Most recently, Brian represented CMPA-BC at a MPPIA-BC meeting with Minister Ida Chong (Ministry of Community, Sport and Cultural Development) where the importance of confirmed funding for British Columbia Film was a top priority.

Merging + Media Conference and Master Class – returns for a second year on October 27 and 28, 2011!  We are excited to again be co-presenting this initiative with Christine Lim-Labossiere / Merging Media Productions.  The event programming is focused on convergence and the latest business and creative strategies available to cross-platform producers in the converging media landscape.  Keynote speakers confirmed to date include:  Curtis Marvis, President Digital Media, Lions Gate Studios and Lance Weiler, CEO, Workbook Project recently named by Wired magazine as “one of 25 people helping to reinvent entertainment and change the face of Hollywood”.  Convergence guru Henry Jenkins will also be interviewed for his take on future industry trends.

NEW! LA MARKET PREP OPPORTUNITY FOR BC CMPA MEMBERS

CMPA-BC is coordinating a market accelerator program designed for members interested in obtaining market intelligence in preparation for expanding their business in the Los Angeles market. This training intensive will provide participants with an overview of the current environment, as well as one-on-one time with market experts who will evaluate the participant’s projects and offer an assessment and feedback on suitability for the American/LA marketplace. Government Relations Update

We are pleased to report that Provincial Minister of Community, Sport and Cultural Development Stephanie Cadieux accepted our invitation to visit the set of the television series “Mr Young” this past Friday. Thanks to producers Victoria Hirst, Lisa Richardson and Michael Shepard for helping provide the Minister with a better sense of the domestic industry and the creative and economic impact of a BC owned series.  With the new BC Liberal Cabinet soon to be announced on March 14th, it will be interesting to see if Minister Cadieux remains in her portfolio. International Transmedia expert Anita Ondine kicks off our 2011 Merging Media Program with this engaging Seminar and Lab, presented by Merging Media Productions Inc and the CMPA-BC Producer’s Branch.
